I am marching band percussion adviser in NJ, and paid through the band parents organization. Last year (2008)they gave me a 1099-Misc to include when I filed my taxes. This year (2009) I did not get one yet, and I believe the deadline for me to get it is Feb 1st (just passed).

What kind of action can/should I take?

1) Annoy them until they give it to me?
2) Not include it when I file?
3) Some kind of legal recourse?
4) Contact IRS? (eeeeewwwwww)
5) Something else?

The company has to postmark the 1099-M by February 1st. As long as they do this they are in compliance.

I would give it another week. If you do not receive it by then, I would attempt to contact the agency and ask them to either fax or mail you another copy. If they refuse to provide one to you then you can contact the IRS at that point to file a formal complaint.

The IRS's phone number for those types of situations is 1-800-829-4477. I believe you will want option 2, then extension 154.

Note. I worked for a company for 10 years. They were bought out by another and I worked for them for 2 more. However, they decided to cut pay in order to save expenses. I found employment elsewhere. However, they still had to send my my tax forms at the beginning of the following year.

They didn't.

I called and asked.

They replied it was some technical difficulty, and not to worry about it.

Basically, they had saved money by not paying the government the taxes I had deducted from my check.

I reported them.

By the end of the year they were missing payrolls, and asking people to work for free.

They are now out of business.

Give it time then call and ask. This sounds like it is a volunteer organization - so no one is getting paid to send this stuff out. However, they must still be in compliance with the law. Give them a gentle reminder if you don't receive it...then report them.

My first question is, "Did you earn more than $600?" If not, they are not required to send you a 1099, though you should still report the income under "other income". They may not have been aware of this last year and sent you a 1099 because they thought they must.

If you did make more than $600, then you definitely need a 1099. Like the others said, they don't have to mail them out until February 1st. I would wait until at least February 14th before asking for it. When I worked in Accounts Payable for big company, our rule was that we wouldn't resend out anything until it was at least 3 weeks late in arriving, but I think your safe in asking about it if it hasn't come by the 14th.

I wouldn't get the IRS involved unless the organization is totally unresponsive. If you've requested it, and still haven't gotten your form by March, then it's time to fuss with the IRS.
