I got permission from Annie that I can help revive the Photoshop Phriday tradition. I was pouting that Photoshop Phriday wasn't going on and then thought.... wait a minute... I should stop pouting and just start it myself!

So here is the new website all ready and running.
http://photoshopphriday.4t.com/ It's nice and simple.... nothing fancy.

Does anyone know if http://somethingawful.com has Photoshop Phridays copyrighted? Otherwise I'm probably going to have to change the name of the website...

As of now there will only be one or more posted just once a month. I figured if there wasn't too many protests. It also gives everyone time to make their creations. The topic for now is "Crazy Inventions".
Keep it clean, please. If anyone has an idea for another topic for the month of May please tell me. [Smile]

You can't copyright a name, it would be a trademark if anything.

People use it all over the net, so I doubt it could be defended, and unless you see some sort of trademark notice I wouldn't worry about it.

Photoshop Phridays is where you make a creation using Photoshop that is funny. For example...we did one last year where you made up an animal and I did a uniger (half tiger half lion) I put a head of a unicorn and a tiger together. It was fun... my skills in Photoshop could be better though. [Blushing]

hey guys, I have photoshopphriday.com registered. UW, do you want an account on my server and administer everything from there? This way you can pretty much do whatever you want, have no popups, have excellent bandwidth and lots of server storage space.

I registered it yesterday on a whim (I get a few free registrations with my server account). I just looked it up to see if it was taken, it WASN'T (o_O) so I took it. And I have craploads of everything on my server right now (bandwidth, space, email accounts, databases, etc), so why not put it to good use?

Trademarks are lost if they're infringed and you don't defend them.

That sites other than something awful have been using the term for years almost certainly would scuttle any chance to claim it.

I'd still say cover yourself with a permission letter from SA. The fact that you own the domain "photoshopphriday.com" makes you first on the list should they decide to start defending themselves.

Interestingly, there's a bit of case law accumulating that suggests/holds a domain name cannot infringe trademark.

On the other hand, you could hold the domain and ask for a nice chunk of change to buy it from you.

...although I can't stand the ethics involved in companies/people that do that.

Yet it could also be going the route of Xerox and Kleenex--people substituting xeroxing for copying and kleenex for tissues. And photoshopping for manipulating images using a computer program.

Yes, that's likely one reason something awful hasn't gone for a trademark on the whole thing.

Used as a descriptive phrase, however, I severely doubt adobe would have a case for infringement (likely why they haven't sued, despite it being a common event).

I'm pretty sure they have laywers that do nothing but sue people or at least write them concerned lawyerly letters. But it's hard to get around to everyone who does it, they go for people actually making money off it or otherwise seek to directly erode the unique value of the trademark. Like linguists who write papers about how coke can mean any sweet fizzy beverage.
