In a moment of madness last summer, I joined eDiets, with the understanding that I could quit at any time. HA!

I've been trying unsuccessfully to cancel my membership since January, and I don't know what I should do next. According to their terms of service:

Phone is the way I would go, since then you would (read: might) actually be talking to a person.

Yes, I've sent several emails asking them to cancel. I've called the number dozens of times and never gotten through. All I ever get is a busy signal.

I don't know what else to do. Can I work through my bank? (I signed up to pay with a debit card) Any one else have any suggestions?

Okay, now I'm really mad. I just tried to log in to see if I could change my profile, and it said

But they took another $12 out of my account YESTERDAY!!! And it's the same stupid number that I've been trying to call since November!!!!

You can call your bank and explain the situation, to make sure they don't take any more, at the very least.

You can also complain to the BBB...

Call your bank and tell them that the last withdrawal was no authorized by you and that no future withdrawals are to be allowed.

If necessary, fill out the fraud paperwork to go with it.

Then...write a letter to the company. Send it certified (just so you can verify that it was delivered is fine), telling them that they made a mistake in that last withdrawal, that you want your money back, and that you have alerted your bank to bar any further access to your account.

If that doesn't take care of it, post again. I suspect you could sic the Attorney General on them if they don't knock it off after a warning shot from your bank.

PS: I suspect if you tell them that you've been trying to quit for x months, you could pursue getting a refund. But at some point it's going to be tough to prove. If you have copies of e-mails, etc., that might help, but it's too easily "faked."

Just be happy if you get the last month or two's fees back.

Contact your bank. Unless they have your signature on file for *each* charge, you can do a chargeback and they really can't fight it. I mean they can, but they'll lose. The banks don't care about the merchants.

Does the dispute with the bank still apply since she authorized these transfers as debit transactions and not credit card entries?

Call your bank. Bally's tried to do the same thing with me, and they took almost $200 before it was over. I did get it all back.

Goody Scrivener: dunno for sure. If it was an ATM with a Visa or Mastercard logo, it should. If it was done with account/routing number, I'm not sure, but I would suspect the bank would still firmly side with its customer against the merchant. (Which is a *bad* thing when the merchant is honest and the customer isn't, but good in this case.)

I recently went through something similar and the bank most assuredly did NOT side with me, so that's definitely not a given.

I have the day off today (it's Prince Kuhio Day, a state holiday) so I tried again to call the toll free number for eDiets. I got a recorded message telling me to call 10-15-15-800 for a national directory assistance service in Nevada that costs $4.99 per call. I'm rather perplexed, but even more disgusted with eDiets. Hopefully stopping payments at the bank will work.

With a cousin who works for a credit card company the best advise I can give anyone is to ALWAYS use your bank debit card like a credit card. When you use your bank card like a debit card you are not protected in the same manner credit card customers are. Always choose the option to sign for payments rather than using the ATM code to gain that protection.
