Using botanical definitions, tomatoes (and cucumbers, peppers, melons, etc.) are fruit.
Are you a botanist? Cuz I'm not.
quote: The confusion comes in from the more common usage of the terms fruit and vegetable, which are more related to how the produce is consumed (related to nutrition and food preparation). Most folks think of fruits as something sweet, often used as desserts, while vegetables are generally used as a side dish or combined with other foods in salads, casseroles, etc. So here the definitions are more subject to interpretation by the individual.
