This has not been a good week for America...

Edit: I also hope Pat Robertson is more careful what he prays for in the future.

If Pat has the Big Guy's ear, we are in a tremendous lot of trouble.

I have to say that I thought Rehnquist worked very hard and to great effect as Chief Justice. I didn't always like his opinions but I always got the feeling that he was coming from a good place.

We are screwed. I would feel the same way if a Dem got to nominate too many SCOTUS judges, BTW, I don't think that either party should have that much influence over the SC. Not all at once, anyway.

I've long thought that the way justices are replaced is too random. One president may serve 2 terms and never get to nominate anyone, while in four years his successor may be lucky enough to have several justices die or retire on his watch.

There's too much fortune involved, given how important the system is.

I wish the SCOTUS was less influential, period.

I want them influential. I want them to be able to counter any excesses enacted by the legislative or executive branches. I just hope the new SCOTUS still feels inclined to.

John Paul Jones or whatever is 85.

There is a chance that W will get to appoint 3 supreme court justices.

And the Bush family would get to appoint 5 of 9.

That's scary.

Arrmageddon is upon us.

Err, I can't think of any Supreme Court Judge who has a name similar to John Paul Jones. Could you clarify?

My wife pointed out the scarey news. He died of Thyroid cancer. Her thyroid has been biopsyed with an "inconclusive" result, meaning its going to have to come out before we know if its cancerous. Everyone tells her that Thyroid cancer is not that dangerous, then this....

Excuse me, its time to hold her hand a bit.

While holding her hand, you might also reassure her that she is not an 80-year-old man.

I mean, I know that would relieve me. [Wink]

I don't know if Bush will appoint anyone that different than Roberts. He didn't go all Neo-Con with Roberts, which is a good thing. I hope he does the same with this vacancy and I hope he picks a woman this time.

I think that middle of the road justices are a good choice since most of the country is that....either side getting a complete upper hand would be disastrous, IMO.

Heheh, this is possibly a bit upsetting for Bush. There's nobody on the court he could really "promote" to chief justice, so he has to bring somebody in from outside. However, as Roberts isn't confirmed yet, if he didn't make Roberts his Chief Justice nominee, it would seem like he wasn't expressing all that much confidence in Roberts, that he hadn't picked the best man for the position he was first nominated for.

However, as Bush had to know Rehnquist was likely to leave the court during his term, he may well have had someone else picked out as a likely chief justice.

Furthermore, I suspect that Roberts as Chief Justice is even more likely to become of a somewhat different mind.

A longtime fantasy of mine is to be the mother of a Supreme Court Justice. I could win all the bragging contests over at the Home for the Aged. And I could just pick up the phone and call my son and tell him that he should respect his mother and listen to how I think he should vote.

"Ma, what would you like for Mother's Day."

"A ruling that says that the rights to life, liberty and pursuit of happiness implies equal access to healthcare for all citizenry, dear."

*blink* Wait a sec. John Roberts is the John Edwards of the Supreme Court. What has he done, exactly, in life or in law, to deserve the highest legal post in the entire country?

He held the third-highest position in the Justice department and has an extraordinary amount of experience arguing before SCOTUS - something really only possible by someone whi understands the important differences between SCOTUS and other appellate courts.
