Back in October, I bought something from Ebay. But the seller was sent an incorrect address--an old address I took out of ebay's system a long time ago.

The seller, being a good ebayer, quickly got my item shipped off to me, before I had the chance to let him know it was wrong.

Ebay has since emailed me aknowledging they had a problem with that, but in order for me to get it resolved, they say I have to open up a dispute with the seller. They say that as long as it's determined the seller really wasn't at fault, he won't have to pay anything.

So basically, I'm afraid ebay is going to use this as a way to dump it off on him. I know I could tell him not to worry about it even if they told him to pay, but I don't want some kind of negative thing to show up on his record over it.

Has anybody been through the ebay dispute process? Once it starts there a way I can protect him if I don't have a real dispute with him?

(And ebay buyers, take note--there is no way for buyers to resolve issues with transactions, even if they are ebay's fault, without starting a dispute with you.)

Keep good records of the communications between you and the seller. You can send him emails within the eBay system, that way they will also have records of your conversations. When this is all taken care of, remember to give good feedback for this guy if he cooperates.

I went through a dispute where I purchased something and there were all these things wrong with it that the seller never told me about. I tried to return it and he refused. and I tried to make a deal where I got some of my money back but he refused to give me more than a $10 discount.

The guy was a real prick, and when i checked his feedback I saw I wasn't the first person to have this problem(my own fault really. it was an impulse buy and i didn't check his stats before purchasing).

Anyway, eventually I was forced to make a dispute, which he ridiculed me for making. We did it through paypal, because when you use paypal they handle the disput internally, and only send it over to ebay if it can't be resolved.

They had each of us email our side of the story. After that apparently from what I gathered they talked with him on the phone once or twice. they never contacted me though, and never asked for any email conversations or anything like that. Then after like two weeks they emailed me saying i was getting a full refund.

I'm not sure what, if anything, happened to the seller as a result of this.

So did the shipment that the seller sent get lost in the mail or something? Because if he had the wrong address and the package was returned to him, can't he just refund your money himself? I'm assuming the shipment got lost and he doesn't wan't to take the monetary hit, understandably.

The seller won't have to pay anything - but short of the accidental recipient sending the item back, someone's taking a loss, and it won't be eBay. One or the other of you is going to be out some money or the item.

EBay's whole reason for existence is to provide information to buyers about sellers and sellers about buyers. If they screwed up providing this information (and it sounds like they've admitted it), then you have a good shot and having them take care of it.

I'd contact the seller first and explain that it was eBay's fault (attach the email). Then tell him the only way you know of to fix this is to open a dispute. Ask him if he would prefer to handle it in some other fashion.

It might be that eBay has no mechanism other than the dispute for handling it. They might be fully intending to reimburse the seller, but need you to start the dispute in order to handle it within their system.
