A question for those here with more experience than I.
I have a submission out to a market. I havent gotten a response from them, and its currently 28 days past their "query if you don't get a response in this time" time. So 5 or 6 days ago I queried...and still haven't heard back.
So whats the etiquette for this situation? At what point do I assume a rejection and send the piece along to someone else?

depends on how much you want to get placed with that particular publication, I guess. If I really wanted to be published there, I'd wait a couple more weeks and then send it again, with a note, "just in case it got misplaced in the mail" kinda thing. If you're not wedded to that particular site, don't waste your time on 'em. You gave them time, then a courtesy query. Move on.

Well what I would actually do would be to post the first 13 of the story here, try to get some critiques and improve it bit, then resubmitt. I am not in any way specifically interested in that particular publication. But I don't want to burn any bridges either.
But I tend to agree, they've had more than the requisite time plus a query so..

No harm in going ahead with another round of critique here, whether or not they take it. That would give them another couple weeks or so, depending on how fast you edit, and by then it would be more clear that they didn't want it.

Did you check on that market in Duotrope? They usually tell you reply times and if the market is dead/closed or if they changed information.

I agree with debhoag -- exhaust courteous correspondence and then move on (though I, personally, would write and let the editor know that I was withdrawing the story from consideration...politely of course!).

Merlion, I wouldn't resubmit, unless asked to do so. But, like debhoag, perhaps I'm weird
And I second Gardener's mention of Duotrope -- I find that site extremely useful.
