I know this is an old topic but I could not help thinking about it today at work and wondered NA if circumstances have improved now that some time has passed?

NA, does your son have any friends his age in the neighborhood? Maybe it would be advantageous to arrange with a friend's parents to trade playdates, so that your older son gets to spend more time with his friends and your nieces get to spend time at your house, with your younger son, while your older son is at his friend's house. Surely your brother can't argue against that?
